DMCA Copyright Policy

Booknet respects the intellectual property rights of others and complies with the United States Digital Millennium Copyright Act (DMCA). This page explains how copyright holders can report infringement, how users can submit counter-notices.

Important Note on Copyright Scope:
Copyright law protects the original expression of an idea, not the idea itself. This means that titles, character names, general themes, and similar plotlines are typically not protected by copyright and do not, on their own, constitute infringement.

If you're uncertain whether specific content infringes your copyright, we strongly recommend seeking independent legal advice before submitting a DMCA notice.

Additionally, maintaining a verifiable record of your work helps establish proof of authorship. If a dispute arises regarding originality, the date of first publication or registration of your digital work (e.g., on Booknet or elsewhere) can serve as supporting evidence of your ownership claim.

 

I. Report Copyright Infringement (DMCA Notice)

If you believe that your copyrighted work has been copied and posted on Booknet without your permission, you may send us a DMCA notice.

Email your notice to Booknet’s DMCA designated agent: legal@booknet.com

Please include all of the following information:

  1. Link to the infringing content on Booknet
    Example: Libros para leer gratis online en español - Booknet

  2. Description or link to your original work
    Example: My book "Moonlight Pact" published on Amazon in 2023
    Or: https://yourwebsite.com/original-book

  3. Statement of ownership
    "I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or authorized to act on the owner's behalf."

  4. Statement of good faith belief
    "I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."

  5. Your contact details

    • Full name

    • Email address

    • Physical mailing address: Country, city, zip code, street, building of physical address

  6. Your signature
    You may type your name at the bottom of the notice to serve as your electronic signature.

Important Notes

  • Submitting false claims may result in legal liability. Ensure you own the rights or are authorized to act.

  • We may share your complaint with the user who posted the allegedly infringing content.

We reserve the right to remove content and terminate repeat infringers under appropriate circumstances.

 

II. How to Submit a Counter-Notice

If your content was removed due to a DMCA notice and you believe it was done in error or misidentification, you may submit a counter-notice.

Email your counter-notice to Booknet’s DMCA designated agent: legal@booknet.com

Please include all of the following information:

  1. Your full name and contact details

    • Full name

    • Email address

    • Physical mailing address

  2. Identification of the content that was removed, including the URL where it previously appeared on Booknet.
    Example: The story titled "Shadowlight" previously available at Libros para leer gratis online en español - Booknet

  3. Statement under penalty of perjury:
    "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."

  4. Statement of consent to jurisdiction:
    "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if outside the United States, the jurisdiction of any judicial district in which Booknet may be found. I will accept service of process from the person who provided the original DMCA notification or their agent."

  5. Your electronic signature
    Type your full legal name at the bottom.

Once we receive your complete counter-notice, we may restore the content unless the original complainant files legal action within 10–14 business days.

Warning About False Claims

Submitting false DMCA notices or counter-notices may result in legal liability under Section 512(f) of the DMCA. Ensure you own the rights or are authorized to act.

We may share your complaint with the user who posted the allegedly infringing content.

Please file only legitimate claims.

What if I don’t want to provide personal information in a DMCA notice?

Submitting a DMCA takedown request requires providing certain personal information, such as your name and contact details. This is because a DMCA notice is a legal document, and we are obligated by law to collect this information in order to process your claim.

We do not share your personal details with the other party at the time of takedown, unless legally required (e.g., in the event of a counter-notice or court action). However, if you are unwilling to provide the required information, we are unfortunately unable to proceed with your DMCA request.

How to retract a DMCA notice (if submitted in error)

If you believe you submitted a DMCA takedown notice by mistake or wish to retract your claim, you may do so by emailing us at legal@booknet.com with the subject line:
“Retraction of DMCA Request”

Your retraction email should:

  • Be sent from the same email address or corporate domain used in the original notice;

  • Clearly identify the content to be restored (please include direct URLs);

  • Include any reference numbers or case IDs you may have received;

  • Provide a brief explanation of the reason for the retraction.

We will review and process your retraction as soon as possible.
